Welcome to Here And Now! These terms of use ("Terms") constitute a legally binding agreement between you and IDENTITY ("we", "us" or "our"). Before you start using the Here And Now mobile application (the "Application") and related services, please read these Terms carefully. By accessing or using the Application, you agree to be bound by these Terms.

1. Eligibility:

1.1. You must be at least 18 years old to use Here And Now. By using the Application, you represent and warrant that you are at least 18 years old.

2. Account registration:

2.1. To access the full range of features of the Application, including linking through microlocations, you will need to register for an account.

2.2. You agree to provide accurate, current and complete information during the registration process and to update it to keep it accurate and complete.

2.3. Your account is for personal use only and may not be shared with others.

3. User Content:

3.1. By using Here And Now, you may submit various types of content, including but not limited to photos, text and other materials ("User Content").

3.2. You retain ownership of all intellectual property rights you own in User Content. By submitting User Content, you grant us a license to use, reproduce, modify, adapt, publish, translate, create derivative works, distribute and display such content for the purpose of providing and improving the Application.

3.3. User Content should follow our community guidelines, and we reserve the right to remove content that violates these guidelines.

4. Application functionalities:

4.1. Here And Now facilitates connection through microlocations, allowing users to connect with others who are physically nearby in real time.

4.2. The app provides features like:

• Connect via geolocation: Discover and connect with people nearby.

• Instant connectivity: Build meaningful relationships on the spot.

• Event-focused networking: Enrich your event experience by connecting with other attendees.

• No fear of rejection: We encourage positive and spontaneous interactions, eliminating the fear of rejection.

• User Profiles: Create and customize your profile to reflect your interests and preferences.

5. Prohibited Conduct:

5.1. You agree not to:

• Use the Application for illegal purposes or in violation of local, state, national or international laws.

• Violate our community guidelines or encourage others to do the same.

• Attempting to access a feature or area of the Application for which you are not authorized.

• Engage in any form of harassment, peer violence or discriminatory behavior.

6. Cessation:

6.1. We reserve the right to terminate or suspend your account and access to the Application for any reason, including, but not limited to, violation of these Terms or our Community Guidelines.

7. Privacy:

7.1. Your privacy is important to us. Our Privacy Policy explains how we collect, use and disclose your personal information. By using Here And Now, you agree to the terms of our Privacy Policy.

8. Statements on Continuation:

8.1. Here And Now is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Application will always be secure, error-free or free of harmful content.

8.2. Use of the Application is at your own risk.

9. Intellectual Property Rights:

9.1. All content, trademarks, services, logos and trade names on the Application are the property of IDENTITY or its licensors and may not be copied, imitated or used without the prior written permission of IDENTITY.

10. Changes to Terms:

10.1. We reserve the right to change these Terms at any time. We will notify you of changes through the Application or other means. By continuing to use Here And Now after such changes, you agree to the updated terms.

11. Right of Place:

11.1. These Terms are subject to the laws of the Republic of Croatia, regardless of conflict of laws.

12. Limitation of Liability:

12.1. To the extent permitted by applicable law, IDENTITY shall not be liable for any indirect, incidental, special, consequential or punitive damages, or loss of profits or revenue, whether direct or indirect.
